1. Acceptance and eligibility

By accessing or using muskyatlas.com (the "Site"), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site. You must be 18 or older to create an account, buy a product or membership, or register for a paid event, or use the Site with the consent and supervision of a parent or guardian who accepts these Terms. We may update these Terms; continued use after an update takes effect is acceptance.

2. What Musky Atlas is

Musky Atlas provides musky fishing information and tools: lake and destination information, gear and manufacturer information, casting and trolling tactics, science and lifestyle content, solunar, moon, and weather-based forecast tools (including MuskyCast and the Trolling Depth Lab), directories of resorts, lodges, guides, and tackle shops, a private catch log, digital information products, memberships, and live online events. Musky Atlas is an information and referral platform. Unless expressly stated for a specific hosted trip or product, we are not your guide, outfitter, resort, retailer, or booking agent, and a listing does not create a contract between you and Musky Atlas for that third party's services.

3. Fishing regulations disclaimer - official rules govern

Fishing regulations change and vary by water, jurisdiction, season, and species. Information on the Site about seasons, openers and closers, length and bag limits, live bait rules, trolling rules, night fishing, licensing, and special regulations is provided for general information only, may be incomplete, and may be outdated.

  • The official regulations of the applicable state, provincial, tribal, or federal authority (for example, a state Department of Natural Resources or Ontario's Ministry of Natural Resources) govern.
  • You must verify the current official regulations and obtain all required licenses and permits before fishing any water.
  • Do not rely on the Site, a lake page, a forecast, or another user's post as authority to fish in a place, season, or manner.
  • Report suspected errors to us, but a correction does not retroactively make reliance reasonable.

4. Forecast, weather, and safety disclaimer

MuskyCast scores, solunar and moon windows, pattern suggestions, bait suggestions, and Depth Lab outputs are estimates and educational tools, not guarantees.

  • Fish activity is not predictable with certainty. A high score does not mean you will catch a fish; a low score does not mean you will not.
  • Weather, wind, lightning, water temperature, ice, water levels, and river flows can change quickly and create danger.
  • Boating and on-water safety are your sole responsibility. Check official weather and marine forecasts (for example, the National Weather Service or Environment Canada), file a float plan, wear a life jacket, carry required safety equipment, observe navigation rules, cold-water and heat precautions, and do not fish in conditions you cannot handle. Never rely on the Site for emergency, navigation, ice safety, or severe weather decisions.
  • Fish care: water temperatures and handling affect survival of released fish. Follow current best practices and any official guidance for the water you fish.

5. Accuracy of lake, product, and directory information

Lake data (acreage, depth, forage, strain, stocking, survey results), product specifications, prices, dive-depth data, resort and guide details, and availability are compiled from public, manufacturer, partner, and user sources and are provided "as is." Sources and check dates are shown where practicable. Information may contain errors and changes without notice. Dive-depth figures are estimates affected by line, speed, lure variation, current, and rigging (see also the Depth Lab labeling in our Compliance Checklist). Verify critical information with the official or manufacturer source before a trip or purchase.

6. Accounts and catch log

You are responsible for activity under your account and for keeping your password confidential. Provide accurate information. Catch logs are private by default and governed by our Catch Log and Photo Policy, which is part of these Terms. Do not log false catches as verified, manipulate verification, or use another person's account, photos, or catches as your own.

7. User content and license

You retain ownership of content you submit (catch logs, photos, reports, comments, reviews, and similar content, "User Content"), subject to this license:

  • Private content: we use private User Content only to operate and provide the service to you (storage, display back to you and your chosen trip group, export, aggregated de-identified analytics as described in the Privacy Policy).
  • Public content: if you choose to make a catch, photo, report, or other content public, you grant Musky Atlas, a Brand Forge property ([LEGAL ENTITY - CONFIRM]), a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and create derivative works from that public content in connection with operating and promoting Musky Atlas (for example, a Trophy Board, lake page, social post, or recap of a live event), with attribution to your display name where practicable.
  • You represent that you own or have permission to submit the content, that it is accurate to your knowledge, and that it does not infringe another person's rights or violate law or these Terms.
  • We may remove or make private any content that violates these Terms, is reported for a rights or privacy concern, or that we reasonably believe is false, unsafe, or spot-revealing contrary to policy. Removal requests are handled under the Catch Log and Photo Policy.
  • This license for public content ends for future uses when you delete the content or make it private, except for copies already distributed (for example, a social post or printed material) and backup copies retained for a reasonable period.

8. Prohibited conduct

You agree not to:

  • Violate any law or fishing, boating, or wildlife regulation, or encourage another person to do so.
  • Post another person's exact fishing locations (GPS coordinates, marked maps, or pinpoint descriptions of another angler's spot) without their consent, or engage in conduct intended to expose or overwhelm a specific spot contrary to our Catch Log and Photo Policy.
  • Submit false, misleading, or unverified catches as verified; impersonate any person, guide, resort, brand, or Musky Atlas.
  • Scrape, crawl, bulk-download, or systematically harvest Site content, lake data, dive data, directories, or user information, or use automated access that burdens the Site, except for search engine indexing in compliance with our robots directives.
  • Copy, resell, or create a competing database or product from Site data, dive-curve data, or compiled listings, except as permitted by law.
  • Upload malware, attempt to gain unauthorized access, probe or disrupt the Site, or circumvent paywalls, membership controls, or rate limits.
  • Post unlawful, infringing, defamatory, harassing, hateful, sexually explicit, or spam content, or unsolicited commercial messages.
  • Use manufacturer names, logos, or product images in a way that implies endorsement of your own product or service.
  • Misrepresent an affiliate, sponsor, or partner relationship.

We may suspend or terminate accounts and remove content for violations, without limiting other remedies.

9. Affiliate, commerce, and partner terms

  • The Site contains affiliate links and paid partner placements. See our Affiliate Disclosure, which is part of these Terms. Sponsored and partner content is labeled.
  • Purchases made on a third-party retailer's, resort's, or manufacturer's site are governed by that seller's terms, pricing, shipping, taxes, and returns. We are not responsible for third-party fulfillment.
  • Bookings and inquiries: an inquiry submitted through the Site is a request forwarded to the selected business. Availability, price, and terms are confirmed by that business, not by Musky Atlas, unless a specific offer expressly states otherwise.
  • Prices on the Site are shown in the currency indicated where practicable and may change without notice; the price at checkout (ours or a third party's) controls.

10. Digital products and refund policy

  • Digital information products (for example, lake breakdowns, playbooks, courses, masterclass recordings, and depth packs) are delivered electronically after purchase.
  • Refund policy (info products): If you are not satisfied, request a refund within 7 days of purchase by contacting support through the Site. We will refund the purchase price to the original payment method if the request is made within that period and the product has not been substantially copied or redistributed in violation of these Terms. After 7 days, sales are final except where required by law or expressly stated on the product page.
  • Access is licensed for your personal use only. Do not share, resell, publicly post, or redistribute purchased content, accounts, or downloads.
  • Live events: tickets are refundable or transferable only as stated on the event page. If we cancel an event, we will refund the ticket price or provide a credit, at our election as stated on the event page. Recordings, where promised, count as delivery of the event content.

11. Membership (Musky Atlas Pro) and cancellation

  • Pro membership is billed through Stripe at the price and interval shown at checkout (for example, monthly or annual), renewing automatically until cancelled.
  • Cancellation: You may cancel at any time in your account settings or by contacting support. Cancellation stops future renewals and takes effect at the end of the current paid period; you keep Pro access until then. Fees already paid are not refunded except as required by law or expressly stated at checkout (for example, a specific launch guarantee).
  • Founder or lifetime offers, if offered, are governed by the terms on that offer page, including any cap, transfer, and program-continuation terms stated there.
  • We may change membership features and pricing for future renewal periods with notice posted on the Site or sent by email before the change applies to you.

12. Intellectual property

Site content, compilation, design, MuskyCast and Musky Atlas names and marks, Depth Lab presentation, and original text, graphics, video, and data compilations are owned by or licensed to [LEGAL ENTITY - CONFIRM] (Musky Atlas, a Brand Forge property) and are protected by copyright, trademark, and other laws. Manufacturer, retailer, resort, and other third-party names and logos are the property of their owners; their use on the Site is nominative (to identify the product, brand, or business) and does not imply endorsement unless expressly stated. Limited personal use: you may view and print pages for personal, non-commercial fishing planning. Any other use requires written permission.

If you believe content infringes your copyright, send a notice with the information required by the DMCA (17 USC 512) to our privacy contact or a designated agent at [DMCA AGENT - CONFIRM]. We will respond to valid notices and may terminate repeat infringers.

13. Disclaimer of warranties

THE SITE, TOOLS, FORECASTS, DATA, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any fish will be caught.

14. Limitation of liability

To the maximum extent permitted by law: [LEGAL ENTITY - CONFIRM] (Musky Atlas, a Brand Forge property), its owners, employees, contractors, and partners are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost trips, lost fish, or data loss, arising from use of the Site, reliance on information, forecasts, regulations summaries, dive data, third-party listings, or third-party products and services. Our total aggregate liability for any claim arising from the Site or a purchase from us will not exceed the amount you paid us in the 12 months before the claim, or USD $100 if you paid nothing, whichever is greater. Nothing in these Terms limits liability that cannot be limited by law. You are responsible for your own safety, regulatory compliance, and decisions on the water.

15. Indemnification

You agree to indemnify and hold harmless [LEGAL ENTITY - CONFIRM] (Musky Atlas, a Brand Forge property) and its personnel and partners from claims, damages, and reasonable attorneys' fees arising from your use of the Site, your User Content, your violation of these Terms, or your violation of law or another person's rights, to the extent permitted by law.
